Checking In

We had a pretty good week on Hometown Radio — thanks for tuning in, and a special thanks to those of you who made the effort to call in. As I always remind people, less than 2% of people who listen to talk radio will ever pick up a phone and call in to a talk show.

Still getting a response to our segment on housing construction with Consumer Guy Al Brill (consumerguy@charter.net). As promised, here’s the little ditty that Paul from Paso called in with:

If the grading is off… The Cement Masons will level it out
If the Cement is not level.. The framers will straighten it
If the walls are not straight… The drywallers will cover it.
If the drywall is wrong the painters will hide it
If the painters goof it the home buyers will never notice

Coming up this week. . . . Rich from Paso Robles, who appears all over this blog, will be on Monday to discuss recent calls from within upper military ranks for Donald Rumsfeld to step down. Also, we’ll revisit immigration, this time with members of the local Filipino-American community. On Tuesday, there’s a new group out on the coast called POPR, Protect Our Property Rights. They’re not very happy with Bruce Gibson — we’ll find out why. Radio-Tradio is set for Thursday.

We’re also going to have the three candidates for District II supervisor make separate appearances during the first week of May. We’ll also visit with the three candidates in District IV later in the month.

Don’t know about you, but I’m glad former SLO police chief Jim Gardiner saw the handwriting on the wall and dropped out of the sheriff’s race. To be honest (and I told him this directly), I never understood why Gardiner decided to run in the first place.

Good news . . . . Sparkle, our white-pit-bull-Pet-of-the-Week from Friday, as predicted, went home with Jan from Arroyo Grande today. That, my friends, is the power of radio.

More good news . . . .this should be the week we start streaming my show and the morning news on the Internet. The equipment has supposedly arrived and management says things should happen sooner than later. Can’t wait.

Finally, we’re putting the final touches on the bus trip to the Reagan Presidential Library. Something should be happening prior to May 19th. Hope to make the official announcement this week.

    Please consider this:

    When ever I read anything about Iraq or Iran and criticism of “Bush’s” ie “American” policy for same, I never see anything written about the fifth LARGEST nuclear power in the world.

    That power is Israel.

    Although this power is NEVER
    discussed , it is the BIGGEST consideration of our foreign policy.

    Do any of you feel that “Never Again!” is a hollow threat?

    Agreed. Do you think for a second that anyone who has nukes really thinks about using them except for retaliation? (anyone, apparently except President Bush) If any nation in the world uses a nuke in an act of agression, the rest of the world will hold them accountable in every way possible- no matter if that country is Israel, Pakistan or even the United States. Period. There is no debate on this, at all.

    You were right on the MONEY after all it is all about the $$$$ these builders have been building cheap, substandard homes on the Central Coast for years! RW Hertel & Sons that is look at ALL the Lawsuits against them not to mention there illegal “Dirty Deeds” Dumping waste ( In the Salinas River Bed) to make way for more cheap homes at Las Lomas it is about time some one spoke up, keep it up and where are the Inspectors ???? or shall we say who’s Pocket are the inspectors dipping into ? how could so many homes be defective unless someone in the city was not on Hertel’s back door bank ?

    The RW Hertel inspector on Rancho Obispo were Mark Ellery who has long been suspected of miscondut over the project, he failed to properly inspect due to his mere incomptency. He only inspected 4 of the model homes even then they are now defective as well. He was replaced with David Fogg who if you check these guys backgrounds they are FAILED, I repeat FAILED want-t0-be builders so when your a failure you go to be a civil servant ! they became way too close to the project managers for Hertel and it would NOT surprise me if BRIBES we offered and accepted, you can not built this many defective homes unless someone was Looking the other way…… two city employees on the project left career civil service jobs over there complaints on the project so something is amiss and needs to be a CRIMINAL INVESTIGATION, by someone ?

    The Dirty Deeds article was for the most part a big joke of hype. The reporter does not know much, and the warden is a goofball too.

    The area of the “riverbed” that was filled in was probably the area that was allowed to be filled between the railroad track and the hills south of Rocky Canyon Rd. This is not riverbed folks, unless you think that a road is also riverbed. Even if it was in the floodplain, it would have to come out of the banks of the Salinas river, take out the railrod and Rocky Cyn. Rd, then the river would flow on….dirt….just like the dirt that it would run on anyways.

    The warden, Todd I understand used to poach black brants as a high school kid in Morro Bay. I have heard also the he lets ranch owners and others that give him hunting rights a lot of permits to kill off deer and pigs (like the Paso Robles Ranch of George Hearst who kills deer and pigs at night with Todd’s permission) but tries to “pinch” people who are actually following the law. Now he is such a hippocrite that he would write his own mother a ticket.

    DFG is going hog wild trying to gin up concern to try and get a pay raise since California has not issed a DFG raise forever. We are staffed for the 60’s with a 2000’s population, and perhaps the article was a way to increase pressure for a raise for the poor guys.

    ” Dirty Deeds” story was right on the money, one should first KNOW the Laws both Federal, State, Local it has been illegal for years to dump in the River, and why would RW Hertel & Sons who is under State and Federal Probes !! lie about the permits and then when caught suddenly change the permits ? he is a dishonest builder and has been for years, he beats women and gambles and drinks like there is no tomorrow, his History and many court cases prove his “DIRTY DEEDS”

    Dirty Deeds of RW Hertel & Sons, well the California Department of Fish & Game did an indepth Criminal investigation of the Illegal RW HERTEL Toxic Waste Construction Dirt dumping. What you may not know is the Agent interviewed Hertel’s Project manager Jim Burns of Paso Robles who confessed of the illegal deeds of his employer RW Hertel. Last Week the State requested Criminal Charges be filed against RW Hertel and his subs Whitaker Construction and suspects Steve Holloway and Shanno Dean Bennett as well> Hertel’s Local “Thug” Attorney Adam Morgan Daner has been trying to use his “Influence” $$ to get the DA NOT to charge his client but wants to Blame it all on the Subs ? sounds like Political sneaky-ness to me so will the DA do his JOB and charge RW Hertel & Sons, et al with the Environmental Crimes they committed ?

    Interesting ? RW Hertel & Sons,Inc. who has been building cheap, housing for years has been sued by not only homeowners but his own workers, he runs HFL Express, LLC and others owns several Private Jets, has COOKHAM HOLDINGS of Nevada. Conceals his gambling and women beating matters, and has the ignorance to dump construction dirt into the river and then Lies and Cover’s it Up? I lookforward to what the New Times un-covers this week, I see he hired Barnett Cox & Associates to SPIN his lies and repaint the company image ! Well I know three people who bought a Hertel home and all three have had leaks, Mold and serious defects and where is Hertel ? Not fixing the homes but Gambling his Profits away on the internet ? he is now trying to secure a $ 16,800,000.00 Loan to finish off his DEFECTIVE Las Lomas Mess…. Justice is coming, remember you Reap What You Sow ! JM Reiss Consulting was right when Jerry said about the Hertel homes ” These Homes were built to FAIL” !

    Greed, that is the bottom line, this builder has been and doing this for years. The word Criminal comes to mind here we have an unethcial company being ran by unethical men who do NOT care about ethics, honesty or doing the right thing. I am told he has been selling out his assets in LAs Lomas to Trimark Pacific Homes so Hertel and beet feet and flee to the Patterson area of Sacramento will I have news for him the long arm of the Law can reach him where ever he hides his little head, and those in the Sacramento area know of his “Dirty Dealing” Oh the sweet sound of Justice is coming and i hear the Jail doors are closing in on him…..

    Oh I know a thing or too about Hertel Homes my friend bought one in Rancho Obispo, next to the New Costco and those homes have been leaking and growning Mold for the past two years she sold out and moved away but she says their are over 28 other homes that have leaks and Mold Hertel tried to conceal it and hired Matt Aguilar of SERVPRO to cover it up, Matt got tired of the cover-up and left then they hired Chris Tennant who found MOLD all over the homes he too left, so this is all a bunch of B.S. that Hertel is doing the right thing we went to a Birthday party in one of the homes yesterday and they showed us all the ongoing leaks and Mold so Hertel is once again lying and covering up.,Be wise and do not buy into there other defective mess Las Lomas El Jardin at least the sales guy there admitted the homes were ” Not very well built” and that the last broker Holly quit Hertel for covering up and lying to customers now she works for TRIMARK Homes who bought all the Hertel land in Atascadero

    Talk Radio saved our homes*****Yes, I own a Defective, Mold Laced, Leaking RW Hertel & Sons “NIGHTMARE” home in the Rancho Obispo Project, next to COSTCO..After getting two conflicting and deceitful letters from Hertel in the same week.. I must comment now that I have learned your Show was in part responsible for us getting action done…Homes haved Leaked, and had MOLD for the two years since the project was opened and Hertel has Lied, misled, cheated and altered the entire truth, NOW that the State and I see now the Feds are involved the truth is coming out,I got two letter this week from Hertel one saying the homes are great and only one or two minor problems existthat the real problems are with the owners ? yea right we bought defective homes and enjoyed living in Mold and leaks,ya,ya ya,ya typical Bull then they say oh on June-12-06 we will replace all 53 roofs if you want ? well I have now read over 22 of the Independant reports done on the homes and guess what the 22 i saw all state the same thing all the homes are defecitve and are leaking so I can assume the other reports are the same..We owners have been lied too cheated, and Hertel has committed FRAUD they should be prosecuted and I hope they will. I have learned they plan on coving us the defects and mold damaged items when they re-do the roofs will I will NOT allow it and now we are being told we must use the same roofer who did the poor job inthe begingin ? again ? Petersen-Dean not on my home…Keep the pressure on this horrible & Dishonest Builder RW Hertel & Sons, Inc.

    I sat down with a x-Hertel employee today who worked on the Rancho Obispo Mess, he admitted he was dismissed because he told the Truth about the defects to a couple of the owners, but as he said his mind is clear and heart an Honest one, as a former owner of one of those Mold and Leaking homes I’m not surprised problems still exist two years later as the workers on my home were Jason Vinson, Regina Cera, Carrie Steck, Max Samson and the superintendent Massey all admitted Hertel gave orders to ” Band Aid” the leaks and Paint over the MOLD in other words COVER-UP/CONCEAL and then LIE if caught….Lies do not go over too well in a Court of Law Under Oath, so when the Trial starts I will endeavor to return to SLO and watch the facts come out and then maybe Hertel and his chronies will GO TO JAIL….

    I’m reading today’s TRIB and I noticed a story about RW Hertel once again in the NEWS under Criminal Investigation AGAIN for Environmental Crimes on his housing problems! When is the State City going to wake up and smell the roses this company is CORRUPT !! dumping illegal waste dirt in our water ways while trying to make money off of us at the same time this S O B does not even live here so he does NOT care he is the same shoddy builder who screwed all those people in Rancho Obispo with Substandard Leaking, MOLD infested homes….SLO DA it is far too long for Justice put Hertel & Sons in JAIL……

    FLASH ! Hertel is attending a meeting tomorrow night at 7 PM at 899 Pacific St. in the First American Title company with members of the Rancho Obispo HOA where Hertel built all those defective homes.. also present will be State Investigators so this should be interesting……

    I own a Hertel Home in the Rancho Obispo Development. I have two things to say…

    ONE; I am more than satisfied with my experiences with Hertel and their staff. I have had no water intrusions in my home and neither have many of my neighbors. I enjoy working with the Customer Service people and I believe they are well aware of how to actually repair any issues. They have been prompt at returning calls and have always been on time for service requests.

    TWO; The Rancho Obispo Development is under scrutiny because of two GREEDY homeowners who have blackballed our community by lying to the press and commiting insurance fraud by filing multiple false complaints. These two homeowners will burn in hell for the lies they are telling. Hertel is going above and beyond to make necessary repairs and replace every roof in the subdivision.

    Hertel is a stand up company and I am happy with my home. I can’t wait for the two idiots who have been lying to the press get featured on some KSBY expose about insurance fraud.

You are a COWARD after all you are the VP of RW Hertel and had to BUY back 1771 Singletree Ct. for 750K due to the MOLD and DEFECTS as was stated in JM Reiss REPORT the ” HOME WAS BUILT TO FAIL” with that said why did it take the CSLB, and now the Fed’s to get your cheap lousy company to be forced to replace the Roofs ? after owners complained for two years……I see you and your crooked partner Ron Hertel are under CRIMINAL Investigation… a public record.. and why did the City inspector admit on the record over 16 complaints and the state Report from Johnny Z says the Entire Development of Rancho Obispo is DEFECTIVE…and the Civil Engineer’s and PE’s confirmed that and more that 27 people complained of MOLD in there homes and DryTech, Farmers Ins., AAA Insurance, HOA Insurance, SERVPRO, APC, MOLDHITMAN, and many others including your own person the MOLD LADY all confirmed in all there reports massive MOLD issues… so Bob your appearence last week at the HOA meeting was a joke as you were laughed out..so take your bags and get ready for JAIL..     I went to the Court House here in SLO and Yes I soon learned numerous Law Suits against Hertel and funny thing Hertel has lost all the suits and still has two major one’s pending in SLO, Kay Reid in Ventura and according to the Court records Hertel tried to settle for $25K she blew that off and is going to trial, as are the other many cases in Sacramento and other Courts. This entire matter will all come out in Court and those who are the LIARS and Perjure themselves will pay the price the California License Board has many signed and verified complaints against Hertel as does Hertel’s own inspector’s and I noticed Hertel on the City Council Record was shown to be a ” Cheap, Shoddy, substandard builder, ? Julie Corona’s home has mold and Hertel tried to keep her silence and today my friend said Hertel looked at her home again now the 11th time in Rancho Obispo so I have concluded factually Hertel builds lousy crappy homes and according to the court records the suits prove that so next time I buy a home I will make sure it is NOT a Hertel home, Hertel should have been a real honest man like his father who started the company, he was a good honest man of integrity when Greedy Son Ronald W. Hertel took over it all went down hill, and Ron never steps to the plate he always has ” Bobby Fowler Boy” or one of his cheap lawyers cover for him, too bad once Hertel did build nice homes but that was a long long time ago…..

    Interesting topic, a Crooked builder V. Victim home owner. I too got my interest peaked so I did a Nexius-Lexius search and a do-diligence the most recent case against RW Hertel is in Sacramento Superioir Court CS # 05AS0471 but there were many, many, other’s all over the State. It is apparent this guy is a “Bad” Builder and according to the settled cases against him he has a very lopng History of poor quality building and is a ” Bully” so I went one step further I asked a friend in the Official channels and good enough RW Hertel and several of his associates are indeed under a Major Probe for misconduct some of which are in fact Criminal so the Truth will come out all in do time, so I recommend relax Justice will prevail. After All the Enron boys were found guilty after professing they are innocent. I suspect the government will find this company guilty as charged..

    RW Hertel & Sons, Inc. tries to BUY his way out of wrong-doing ! I see where the State Fair Political Practice Commission has in fact listed Hertel as a major $ Donator to State Senate election fund of District 35 want-to-be Senator Diane Harkey ? so I wondered why would a well know Crook as Hertel who has a State wide reputation for building below standard homes and sells them for top dollar want to give money to a ” No Body” down in Orange County when his business is NOT in district 35 ??? Ah then I learned he wanted to borrow in disguise millions of dollars and since NO Bank would loan knowing his poor reputation he went to Dan J Harkey CEO, of POINT CENTER FINANCIAL, Inc a hard money lender and loan some money on the condition Hertel ” Kicks Back” to his wife’s political fund of which Dan is also Finance Chairman, Hertel kicks back the money and gets the loan ? maybe the FBI should be investigating all of this illegal and suspicious money activity ? dirty deeds, dirty Politics, corrupt builder etc..Maybe it is time for a FEDERAL GRAND Jury Probe….

    Knowing a few investor’s who own RW Hertel homes in the Rancho Obispo development, I asked them to tell me what they know, I must admit I was shocked at what they said, Hertel owns two homes one at 1788 Singletree owned by Hertel VP Thomas Habbick his own homes has had numerous leaks and MOLD, he is selling it this week well below market value to get rid of it, and Bob Fowler Hertel VP had to buy back 1771 Singletree Ct. due to the owners getting ill from the leaks and MOLD so it is safe to say from my friends who also will be selling out soon the entire Development is one big mold filled Leaking defecitve project and Caution to those buying the homes

    As a Lanlord in this now well KNOWN defective RW Hertel Development of RANCHO OBISPO, I inquired as to what is going on. I soon learned Hertel is running a front for local investor Rob Rossi and his homes with Hertel are the priority not Rancho Obispo, I soon learned of the investigations and problems..Just this week Hertel Employee Max Samson said Hertel hired Central Coast R & R Locksmith ot change the Avila Beach Office locks since they were going to fire someone for leaking to owners the massive Mold and Defects on Hertel homes from Spanish Oaks, Goldenrod, to Rancho Obispo and Rob Rossi’s leaks as well, he also said Mike Werner’s DAD Richard Werner was taking over as a new VP for Hertel and the real culprits in the Defective Cover up’s are Jim Burns, Robert JS Fowler, William Zech, Dana Levy, Brian Hertel, Clayton Hertel, Daddy Ron W. Hertel, Mike Werner and a racist they use to file false complaints against Mexicans who either buy Hertel Homes like Isabel & Miguel Servin, or those work for Hertel, Her name is Regina Cera she takes her orders from Jim Burns who gets his orders from Robert Fowler she says they are all Racist’s so to those who are being victimized by Hertel REPORT them to the FBI, FTB, CSLB Patrick Halvorsen, and the State Attorney General’s office as well. We shall not allow they to lie, cheat and cover up, Max said he took the day off back in April-13-06 to talk to some of you owners on the cover up. So Speak to the Law…

    HERTEL- Rancho Obispo Defective Homes, Now that I have completed my studies i can tell you why you all have so many problems. First several of us interns worked on those homes and as students of Construction Management we were thought of dumb students by STEVE, CHRIS,JUAN, and Jim Burns the Hertel Project manager. We witnessed first hand the ” Stoned and Drunk” workers time and time again doing sloppy below standard work, leaving off manadatory items.. Crickets, Flashing, Z-Bar improperly done etc.. it was a joke to see workers smoking POT and Drinking on the job let alone the abuse and use of Meth…Recently they held Pot parties at 1769 Singletree Ct. in the back with Regina Cera, Carried Steck, Max Samson, etc.. they Ben Steck gets fired for having a Criminal DRUG background and other employee’s abusing and using drugs, Regina hated Mexican’s so she would make false complaints to Jim Burns to get them fired or removed,, last week we learned the home where the Drug parties were held is owned by Robert JS Fowler a Vice-President with Hertel, so now you know why the homes leak.

    HERTEL & MOLD = Rancho Obispo Problems, good site I used rent their came back this week to visit an old classmate and learned my old home which was a leaking one from last year we reported it to REG Property management they did nothing. So guess what we just learned the Owner from San Diego KNEW her home was full of MOLD and waited until we all moved out and this past we saw the MOLD busters at the home 1720 Singletree Ct., SLO I asked them what was happening they said the owner hired them to get RID of the MOLD and to bill RW hertel since it was their issue so Yes, we lived in a mold home and Hertel and our landlord Covered-it-up until we left, well I am telling the other renters and plan on getting a Lawyer this hertel is a LIAR and a FRAUD. Now we are learning almost all the HOMES HAVE MOLD, and the buuilder Covered it up.. Where are the New Roofs too ????? Crack heads no wonder why all the problems they were all on Dope !

    I live in the Rancho Obispo Development built by RW Hertel & Sons, as i was leaving for work I noticed a bunch of trucks Smith & Sons Mold Remediations at 1720 Singletree Ct I asked why ? was told TOXIC MOLD is all over the homes ! another Hertel Fraud sellign homes with leaks and NOW MOLD

    Hertel is at it again, still more than two years later and after they told all of us they would replace all the roofs over 9 months ago ! Still NOT ONE NEW Roof and the defects and Mold continue. Then I am told and I verified it in the Court Hertel is now being sued over there new development in Atascadero under Atascadero Ventures, LLC at El Jardin Las Lomas another Hertel FRAUD and SCAM, one Julie Blow sued Hertel when there model home was found to be defective and she got hurt badly not she has to sue for her injuries, she should be glad she did NOT BUY one of the mold and defective homes there or at Rancho Obispo and Yes, another year of leaks and Defects NO NEW ROOFS, the City of SLO said ” Well after all it is Hertel, and you CAN NOT add much truht to what they Promise” They LIE.

    I note with keen interest the recent sotory on the Front Page of the Tribune over bad builders, Low and behold RW HERTEL & SONS, INC. why on earth do this bad builders NOT learn the lesson of how to build a House, correctly. I have learned as well he has spent thousands on illegal betting and gambling. His Horse Mei Mei in Arlington Park ,IL and his online and Las Vegas Gambling and now his broker Lisa Sabo of Coldwell Banker Ventura is told to sell his defective million dollar homes in Santa Margarita Farms. All while those poor saps in Rancho Obispo still suffer from defective homes, leaks, foundation cracks, improper measured property lines, etc.. then his employee’s get caught using drugs and boozing on the Job it is no wonder why the homes all leak. Now he is building homes in Atascadero at Las Lomas El Jardin and he has suits against him over defects there as well, nice to know King Ventures is fixing his problems. Yet this Hertel CON MAN steals, lies, cover-up’s and I hear sues his buyer’s ? Why would anyone ever buy any home by RW Hertel & Sons, Inc

RW Hertel homes Toxic Mold once again was discovered this week in both Rancho Obispo and Now their New Model homes in Atscader at El Jardin Las Lomas, this is the same Hertel who has lied covered up and sued his own buyers who told him of the defective leaking homes, today under the roofs of two more homes major mold was discovered this guy will never learn, and now our HOA is broke and the HOA insurance has cancelled.

    HERTEL a name associated with cheap rotten and mold laced leaking homes, again at 1708 Farrier Ct. in SLO at the well known defective project of Rancho Obispo they caused more leaks and flooding so bad SERVPRO has to come and fix it again. The workers re-doing the already defective roofs were Drinking on the Job and busted a water pipe from the home fire sprinkler system so go figure now we know why the homes leak and ahve MOLD they workers Drink on the Job. Atascadero Ventures, LLC is another problem project for Hertel known as Las Lomas El Jardin…

    RW Hertel and Fraud go hand in hand they sold all the low income homes in Rancho Obispo as nice homes now it turns out they are all defective and have MOLD one more is 1965 DeVaul Ranch Dr., SLO Mold and Mildew was found in the walls and ceiling and Hertel told the workers to COVER it UP mor eHertel Fraud, they also got caught in Arroyo Vista near Dublin, CA in a HUD Scam for housing fraud as well with low income crappy homes..     Geese, Hertel again he is always getting itno trouble now with more defective homes, I spoke to one city offical today and now by order of the State he is re-doing the roofs finally after two years of MOLD and Fraud in Rancho Obispo but at least he is facing some serious criminal charges he molested some kids in Ventura and is under a probe so he is not for long the Law is onto him.

It is not hard to build a quality home and get a good price and still they do not get it, now I’m told they did borrow against one of their properties in Calif. to buy and build in Grants Pass Oregon area called Eagle Point then we learn they are connected to well known CON-MAN Reed Slatkin who ripped off millions of dollars.     RW Hertel Happy New year as i got up this morning i saw a ground of Hertel staff breaking up a homes foundation at 1753 Singletree Ct. SLO the Rancho Obispo project which is well known to be defective. When i inquired I was informed the homes are sinking due to faulty construction and lack of proper foundations.. the entire development is a mess and will cost millions to fix properly but Hertel is trying the cheap way out, the homes leak and get mold due to poor and not to code foundations.

    This is quite a line of accusations against RW Hertel. I have friends who live in the Rancho Obispo development and others who have just bought in the Las Lomas development. Supposedly Hertel stepped up and solved the Rancho Obispo problems. The friends who live out in Las Lomas say the transaction was one of easiest buying experiences they’ve ever had, and are quite impressed with the quality of their new home. One of these owners said that there’s some strange guy in the community who’s Hell bent on destroying Hertel’s reputation, and doing it any way he can.

    I have been looking for a home in Grover Beach area. I thought I had found the perfect home. I called the rental company, which is American Property and applied. I was approved.Anyways, they said I could move in January 31, 2007. I gave my 30-notice so I could be out by the 1st of Feb. I gave American propertiy the deposit to hold my new home. It was a $2000.00 but I really wanted this home! I barrowed some money from family and it was all set. I was instructed to go in on Jan. 31 to sign my new lease. When I arrived for my appointment i was told the house wouldn’t be ready for 3-4 more weeks.I told her that I had already given my 30-notice to move, and had my movers packed and ready to deliver all my items at the new house in an hour. I tried to inform her that I would be homeless and had no where to go as all my family lives out of state. She told me that wasn’t her problem. She started screaming at me that she was the owner of the company and she wouldn’t deal with this. Her name is Linda. Linda continued to yell that this wasn’t her problem and that I better stop babbling at her. She is too busy to deal with people. If she wanted to deal with all of her crazy customers that she wouldn’t have started her own business, and hired people to deal with them. I had a few hours to find a place to live. I called my current landlord and asked if I could extend my 30-notice. But she had already scheduled the cleaners and had someone moving in on the 3rd of February. I told American Property I couldn’t wait that long and asked for my $2000.00 deposit back so I could get another place. They told me it was non refundable and they wouldn’t give it back unless I took them to court. And if I took them to court, they would counter sue me for everything I own plus attorney fees. So basically I lost $2000.00. I have to live in the Motel 6 until I get paid again. I had the movers drop all of my belongings off at the local storage. I am just wondering if all this is legal? I just wanted to let people out there know about this company so it wouldn’t happen to other innocent people. It has been the worst experience in my life. I am homeless and it’s terrible knowing you have no where to belong.

    This also happened to me! American Property has taken money from several people. Linda the owner is in and out of court because of all her lawsuits!! I went to the court house in San Luis to find out more about this company and sure enough money laundering, and lawsuit after lawsuit!!! I didn’t do anything when they took my deposit. I have three children and had to find a new place ASAP! They told me if I took them to court they’d sue me out of everything and my kids would be taken away. I cant afford that. My deposit was only $1600.00. Someone should go against this slimy company. Like the other person said..is there anything us people can do?

    I was in the process of turning in my rental application to American Property’s when they told me it wouldn’t be approved or looked at until I gave a deposit. I thought that was rather odd. The receptionist said she was new and she would have someone come out and talk to me about it. A lady named Mary, explained she was the boss and they only except applications from serious potential renters. I was a little uncomfortable handing over $1800.00 dollars PLUS THE APPLICATION FEE without an approved application. She told me it speeds up the process. I wanted to move in soon so I gave her a check. She gave me a receipt and wanted my signature on a received deposit form. she said I didn’t have to read it, it was just explaining the credit check process and legal terms, and if the check bounces I was liable for their bank fees. I read it anyways. It did have a lot of legal terms….in which I have no idea the meaning….but in a separate paragraph is states: the deposit is non refundable on all terms once deposited by American Property’s. That the “potential renter” gives up all rights to the deposit funds. I remember I saw a warning on Craig list. I wanted to thank that person. They may have saved me a lot of damage, time and legal fees!

The consensus among homeowners in Rancho is that of satisfaction. They did say though that they used to have a wako neighbor who was a scam artist and liar who was trying to get money out of the builder. When he was run out of the devlopment by his neighbors he took it upon himself to run Hertel, Fowler and anyone else associated with them into the mud. can you spell SLANDER?

    Hello all! I am new at this blog thing, but I was hearing on the radio the other day about this website. I wanted to say something regarding the Hertel issue. I own three homes built by them. One of them is in the Rancho Obispo development. I will stay anonymous because there is a man in that area that will try to obtain some sort of legal action again me if I speak out. I was neutral with him until he started talking about ruining the builder Hertel. I mean yes I did have a few problems with my Rancho house…..but if you have ever bought a new home you know they don’t come in perfect working order. Especially when they are tract homes. I did blame Hertel for the issues, I contacted them and told them the issues and they were fixed within the week. This is a fair trade. I did not have any problems with a leaky roof, or mold but I am not sure I believe others did either. The way this man talked about ruining Ron and Bob Fowler..(I think they are the founders or owners) it wasn’t right. I am sure they do their share of corrupt business…just as ANY LARGE company does. But just as long as they stand behind their homes and fix the problems that do arise…what business is it of ours to ruin someone’s life? We are talking about making a business fail. These owners most likely have children and families to support. Come on Scott leave it alone already.

Almost all of the entries regarding Hertel have been FABRICATED in ONE mans messed up mind. Yes Hertel has lawsuits against them…what builder doesn’t? Look up one of the large builders CENTEX ,for example, lawesuits? Of course! Homes are not an exact science! Things get missed or done incorrectly. That is why there is a customer service department! It certianly doesn’t mean that the owners are “corrupt crackheads” or out to screw the world as this moron would like everyone to believe. He is bitter and has nothing better to do with his sorry life than carry out this vendetta he has against Hertel. This guy is a joke!     Have you actually done your homework? Or did you just read the blogs? If you did research you would know that hertel did not sue a homeowner to cover up his building issues ,but because the man was going to the press making slanderous accusations. Just like the ones you have read online. Do you think that the owners are actually responsible for the physical building of these homes? No they are not. If anything they are only at fault for hiring the wrong employees or sub-contractors. I understand that people get angry when thier home has problems. I am a homeowner who spent my hard earned money. And I expect that the builder of my home should be held responsible for any major defect. Which Hertel did. I would never set out on a quest to ruin the owners lives and reputations, which is what is happening here. It has turned into mob mentality against these two men and it is wrong. I know someone who is close to the company and everyone knows that this guy is out to get them. I can not divulge my identity or his for fear of retaliation. However when all of the legal dust settles I am confident that he will be shown as the real fraud and crook. The homowners with leaks had a very legitimate reason to want repairs. Thier roofs were not only repaired but totally replaced, not just the leaky roofs but the entire project. Why did it take so long? Hertel did an investigation and found that the roofer (local Company) cut corners. Why wasn’t it caught in inspection? Who knows ask the county inspector. As for all of the other personal accusations against these two men…who cares we all have skeletons in our closets and really they are none of anyones business. Would you want your dirt all over the internet? Look up litigation involving any other builder Pardee, Regis, Centex (look at Dove Creek in Atascadero CA) there are numerous lawsuits against all of them. If you don’t like Hertel don’t buy one of thier homes, but don’t try to ruin the poor men!

    FYI: The Company Enviornmental Mold Sampling whom some of the Hertel project Rancho Obispo owners used to determine that they had “toxic mold” in thier homes, was run by Phillip Fry who is now living overseas as a Fugitive and is being hunted by the FBI for convincing homeowners they had “toxic mold” then commiting Insurance Fraud. Don Bagert,of Paso Robles,who did the tests in Rancho is also being sought by the FBI for Fraud, he worked with Fry. Also, all homes built with wood have a small amount of harmless mold in them because all natural wood has mold spores in it. When the wood gets wet, mold will grow. The true “toxic mold” is VERY rare. It takes a very long time to grow and must not only have water but a source of bacteria. “toxic mold” is usually the result of “waste water”(from a toilet or garbage disposal) leaking for an extended period of time.

    Just thought this was a useful piece of info since Hertel is getting slammed for “moldy homes”.

    As a Retired Para Legal Alison Manes, I did some Public Records, FACTS on the State, City, County and several Superior Courts State wide. RW Hertel & Sons does indeed have massive State wide problems, numerous Mechanics Liens, many Judgments, many investigations whom found Hertel at fault. I spoke to San Luis Obispo, City Official who said this week he issued again defective notice over Hertel homes so the problems are indeed Hertel’s. He needs to take action he is the GC of record don’t blame the subs Hertels man on the job JJ Burns admitted to a friend the Rancho Obispo Project was a Con and Scam of cheap building.

    All public records CSLB, BBB, City Hall County Records and News papers who investigated Hertel and of course the Superior Courts. His reputation is horrible state wide..Islay Pointe, Rancho Obispo, Mallardgreen, Willows, Arbors and Spanish Oaks all have problems according to the public records and I called three mold firms who adimtted Hertel homes have many mold problems

    Your right NO ONE CARES about Hertel but at least do not misled those who he continues to screw he now has 3 cases in SLO Superior Court , El Jardin of Atascadero 3 CV060263, ARBORS CV 030497, and Rancho Obispo CV 050606 and those are the ones the clerk knew of she said there are many more in Ventura Court, and if you look on the internet Hertel has issued of trouble all over the State for the past years, and now i see the City of SLO Don Wright another public record has issued another notice of violations of defective home for Rancho Obispo and the Code enforcement man Tim Girvin is quoted in the Press as saying Hertel has problems and the city has sent notice’s of these many defects as did the STATE CSLB who released a Press Release so the facts are well known, I see Hertel has lost every case against them and more are coming so this is bigger than any one person since over 20+ owners of Hertel defective homes have filed complaints all over the State including Kay Reid of San Jose who settled. Arbors is suppose to settle next week again Hertel is GUILTY… FRAUD Smith & Sons and Serv-Pro were hired by Hertel to help them with the massive MOLD in HERTEL’s Leaking Homes after Hertel got caught.

I was a sub of a sub on a Hertel mess and my boss had to file an action against Hertel in Santa Barbara Superior Court, in Santa Maria # CV060005 just to get paid. So I only know what the courts have decided and of course the public recors of the State Investigtions into Hertel below standarnd building. Also As Mr. Barlow wrote from Stockton they to have issues with Hertel. As Does the Knolls

    Thank Yous KVEC and the Consumer Guy for exposing this Builder RW Hertel & Sons, Inc. I did a quick google and see he has serious problems from Pasadena, Ventura, Los Angeles, Vacaville, Stockton, San Luis Obispo, Santa Maria, Atascadero, and Santa Maria. The first thing that popped up was a State of California Press Release on his Shoddy building and then all the complaints and Mold problems with his defective building. I was interviewed yesterday at Embassy Suites by a Private Investigator doing a investigation on Hertel for a Major Insurance Company who has been defrauded by Hertel as he said tomorrow in Dept.3 the ARBORS who sued Hertel for Defects and MOLD is set to have Hertel and his insurance pay out for Hertel shoddy building. I see in the Newspapers in San Jose, Ventura, Los Angeles, and Ripon calif. all have had serious problems with Hertel cheap building. Stop the finger pointing and do the correct thing build good homes and quit lying and covering up the Mold, Leaks and Defects. I notice an Article exposing Hertel on The Knolls at Hiddenbrooke” another Hertel defective project.There is no need to cuss it only shows your need for mental help and low IQ sounds like you work for Hertel.

    I found some interesting facts out on a scammer. I received an email from someone on this page telling me to look at all the postings. I found the man you all speak of Scott Barnes is mad. He is completely mad. He was in prison for scamming people and I guess he had several law suites for scamming other business..slip and fall…vehicles, etc. I do not own a home built by R.W Hertel, I actually have never even heard of them. I did some research on them too. They so far are like any other builder, or realtor. I am not understanding why this Barnes man is on RW Hertel so bad. I would like to know what he is doing to the other builders in the area? You know they are all the same right? What….does his ex wife work for the company? All I know is this Barnes character is MAD, and he had PLENTY of skeletons in his closet..some, very comical. If I were him, I wouldn’t draw attention to myself. You people that are spending all this time blogging….first why don’t any of you work, second…do your research before you post, lastly…public record files are open to ANYONE!!! Don’t just take peoples word for things..LOOK IT UP!

    Let me share with you all my experience with trying to buy a New LOVR-SLO, RW Hertel & Sons home in Rancho Obispo in late 2003 and early 2004. My Broker was told NO outside brokers and no sharing or splitting of any commission’s ? RED FLAG # 1 Then I was informed by Holly, Lori the brokers for Hertel NO HOME Inspections RED FLAG # 2 it now gets worse, I asked for a MAI Certified Appraisal they too said NO RED FLAG # 3 I asked for a Termite Inspection again NO RED FLAG # 4 finally I agreed only to be told NO Offers only asking price that was now RED FLAG # 5 I did not buy and thank god i did NOT, but my fishing buddy did, he still 4 years later still can not sell his home ? Too many defects, and yes MOLD and continued leaks. I should be thankful of Hertel’s RED Flags I do not point fingers or make these silly other Statements but one thing is on the Record and it is all over the State Front Page Major News stories of Hertel’s very poor building. Since Hertel still has many well Known Lawsuits I would suggest you all attend the Trial’s they will reveal the truth and yes the CSLB has made it very clear Hertel and the 50+ so called Johnny Zamerzal reports tell a scary picture of Hertel’s now major problems.

May I suggest to you ALL who ever you are stop the bickering, name calling, venting and vetting on the web and where ever else you all do. It is hard enough to sell homes in a good market and this is not helping matters. I am sorry for all those who feel they have bad homes and the best thing is Mr. Builder stop your stuff as well as all you who are complaining first take a deep breath think and relax, builder’s do the right thing get new or better managers and do NOT point the fingers at anyone fix the homes apologize all of you stay out of Courts the Lawyer’s are the only one’s who win and no more internet stuff valid or not. To say I’m sorry heals faster than anything and forgiveness is a blessing. OK

    My husband and I are retired and were looking at the Las Lomas development in Atascadero. We asked the sales lady who built the home and with great hesitation she answered Hertel. We thought the homes were cheaply built, but like the area. We always do a google search on companies before we buy and were appalled by the number and severity of the complaints by previous home owners. Thank you all for posting your opinions and past experience’s with this builder. We will definately stay clear of any homes built buy them.

    This is an article from a Local paper that was published last year. The man responsible for ALL of the outrageous accusations(named in blog above)didn’t just want his roof fixed he wanted $$$ he brainwashed some of our neighbors into thinking they deserved $$$ too. The article is as follows:
    ‘One of the county’s largest home builders has offered to replace the roofs on all homes in a two-year-old San Luis Obispo subdivision in response to an inspection that followed owner complaints.

    R.W. Hertel & Sons sent a letter offering new roofs to homeowners in the 53-unit Rancho Obispo neighborhood after an independent inspector reviewing the properties raised questions about the long-term viability of the roofs.

    Hertel hired the inspector as part of an agreement reached with the Contractors State License Board last fall.

    ‘We stand by our product and want to assure the satisfaction of our homebuyers – today and 10 years from now,’ said Hertel vice president Bob Fowler .

    According to contractors board spokesman Rick Lopes , the independent inspector found evidence of leaks in seven out of 49 homes but raised questions about the viability of the other 42 roofs that were checked, saying they might leak in the future.

    Hertel said it would remove the old roofs and replace them with entirely new ones, contracting the work out. If all homeowners accepted the offer, it would cost the company between $1.6 million and $4.8 million, according to its estimates.

    ‘We have built several hundred homes on the Central Coast,’ Fowler said. ‘We want every buyer to be happy with their Hertel home. We regret that this situation has developed and we are eager to help resolve it once and for all.’

    The board opened its investigation into Hertel, the first investigation the board has ever opened into the company, after homeowners complained that 27 of the homes leaked. That investigation was closed when Hertel and the board reached the agreement to inspect and repair the homes.

    The agreement between Hertel and the state also calls for the company to submit a repair plan addressing the complaints in the development, Lopes said. The board has yet to see the plan, which is due Friday.

    That plan may include some windows, Fowler said. Windows that are replaced will have an additional two-year warranty on them.

    Lopes noted that it is not unusual for a problem with one home to be repeated throughout a subdivision because builders will use the same design and subcontractors throughout a development. He added that he was pleased everyone in the project would have the opportunity to get a new roof.

    ‘They all paid to have a new home with a sound roof,’ he said. ‘We want them to have what they paid for.’

    The roof offer is voluntary, according to Hertel officials, who added there is no indication that every house in the development leaks but said they preferred to handle the situation proactively.

    A representative for the homeowners association could not be reached Tuesday’

    Hertel handled a bad situation thouroughly and professionally they do not deserve the bad rep. We are HAPPY with our home!!

    You were lucky to learn we did not learn of Hertel sham’s and low quality homes until after we moved in one and the first rains ruined the home even after they continued to sell us the line they are built to standards when the MOLD came that was it we are now taking care of it ourselves and do plan on suing RW HERTEL & SONS in the very near future our health and the health of our children must come first. Hertel has lied and concealed the defects far to long..

    How stupid is that. Well the only reason for it is that people think they can get paid off.
    The postings I have seen about Hertel so far by one or two people are ludicrous, this bozo has insulted all the Hispanic workers and gone so far as to call company people child molesters. I would be very leary of anybody of extreme prejudice, this guy is a criminal or crazy.
    I pull no punches when I say you owners are absolutely stupid to jump Hertel and try to badmouth this Company into submission, by blindly following and accepting some idiots personal vendetta against this Company, you are hurting yourselves. RW Hertel once again involved in another Law Suit Hertel who has many problems with his Poppy Hills and other projects is now suing his insurance company in Federal Court after loosing in State Court so now it is Hertel v. Arch Specialty Ins case # 2007-CV01054 since his own insurance companies now know he is a Fraud good part is the feds are watching this case since it was filed in FEDERAL Court they are waiting for him to file false and fraudulent allegations then ?? He gets indicted…

    Why did the CSLB conduct a two year investigation into Hertel and found they violated the standard of building, I do not know the two people listed but what does that have to do with Hertel building and getting caught on defective Mold ridden homes ? the facts are well known in the Courts, CSLB, IRS and the Inspectors confirmed RW Hertel and Sons builds and sells defective homes. Spin spin the truth is in the facts now well documented by the Press and the many news stories and investigative reports that are NOW Public.

    If you believe R.W. Hertel and sons builds quality homes take a nice bike ride or walk on the Bob Jones bike trail in Avila Beach. When you are passing the Mallard Green Housing development you will hear air hammers chipping stucco from around windows and Decks. On three of the homes the entire rear decks were torn off and rebuilt by Bozarth Construction. Guess who built the homes and settled for millions in court? Bingo R.W Hertel and sons. Anyone questioning there building practices needs to see this for themselves.

    No Way, I saw those homes and asked what was up and one of the owners who was watching the repairs confirmed it was another RW Hertel & Sons defectively built project and Hertel was sued and as usual lost and had to pay, Hertel has lawsuits all over the State and is trying to do the same in Woodland, CA but the authorities are on to his cheating scams up there as well.

    I found the Lawsuit information and many more against Hertel, Whitaker, Little, Rossi etc.. SLO Lawyer’s trying to conceal and cover up for them are Allen Hutkin, his Wife Maria Hutkin, David Money who’s dad is back on the Bench as Judge Money and ringleader and conman Adam Daner all these lawyers are sharing information and getting paid to cover up for the scams and loan fraud as well as some Bar ethics have been broken and if the information is correct Judicial Performance is involved since Daner & Money have sought Judge Money to help inside the courts send what ever information you have to sipowitz@myway.com
